Breaking Lords out of prison

So when I try to break someone out of prison, they end up being my enemies and attack/kill me, I tried to break out some Lord I had a bad relationship with back when I was with the Nords and he attacked me so I kept knocking him unconscious/my allies did, now I've founded my own Kingdom and when I try to rescue Lord Meltor the same thing happens, he attacks me and my allies just gangbang him until he gets knocked out so we can't save him.

How do I fix this?

Happens even with native. Just save before attempting to rescue the lord and if he attacks you, just reload it.  It's random and shouldn't be happening every time, as far as I know.
