Bandit boss guard

After challenging boss and beating him I witnessed that his "guard" isnt taken as prisoners, nor joining my party. They just leave. I have to shoot them in the head as well to at least take those unconscious as prisoners. Shouldnt they at least be taken?

Why should they? They did not say that they will surrender if you accept the challenge from the boss.
