Sea King naval battles

When ever I try to fight a Sea King group, after I tell them to surrender or die, it only gives me the option to leave. I can fight other naval battles (slavers, raiders, traders), but not sea kings.

main campaign? if yes, are you in denmark doing quests? if yes, probably you can't attack them cause you are an ally of their kingdom or so i thought when it happened to me..
