It did say in the early access information on steam that certain patches will require you to create a new save.

this was one of the reasons I have chosen not to get early access, as I don’t want to have an interrupted play through.
You can still request a refund. It just isn't automatically granted. It depends on why you requested it. I don't think, for this issue, you'd get it. But if, say, a patch completely makes the game unplayable for weeks, then I suspect you would.
No, you wont get a refund. I suspect you have played much more than 2 hours, since you are concerned about your savegames not loading. After playing 10+ hours, you cant expect to get your money back...

Uncompatible save file from a older patch should happen in the early access phrase of any game, unless you expect no new feature & no fix on major bugs from the developers or you prefer an update frecuency of every a few months rather than every a few days.
