The problem is: the draw rule has been introduced to avoid a team forcing a draw to gain 1 round without a loss and reduce the chances for opponents to make a poit more, and by this way a match could end 10-9, as an example. At the same it can be exploited to avoid a sure loss and try to have a 10-10 instead of a 11-9.
Rules has been designed and a clan exploited them to reach its goal. In this is case it is clear it cannot be something hmm valiant or brave, but it is still within the rule background. And yes, it is  also frustrating for the superior clan in that round.
I don't think you could introduce a subjective way to interpret the rule. 1 vs 5 is not a loss until that 1 is dead. In a madness profile, that 1 could have killed all his opponents spamming or take advantage from the surprise factor, as an example. Rules must have an objective profile.

The problem with rules is that you can't be able to foretell every possible situation and you know that there will always be some way to exploit little flaws in the rules.

I still think that the best way to deal with such situations is to allow to the referee the might to follow his own thought. Maybe we can create a list of "guidelines" (suggestions on general behaviors and factors to be considered when trying to decide something) and update it even during the ongoing tournament.

For example you can write some guidelines on draw rounds like the following:
When a round ends as a draw the referee can decide if the round will be counted as a victory or a draw or replayed, he will consider these things:

[*]Number of survivors in both teams
[*]The score of the opposing players (if there's 1 player left in team A with a personal score of 10-0 and 3 survivors in team B with a score of 0-4 the round is not clearly decided yet)
[*]The behavior of the players (one player running for safety or both teams still fighting at the end of the round)
[*]The duration and the result of the match (if the match goes on for 2 hours and the score is already 19-0 there's no need for a rematch)
