NPC's barter before battle

So, the system for barter before battle seems a bit off.

When I get attacked by the NPC I have to option to:
- Tell them we will fight
- Tell them they should be the ones surrendering instead of me (I don't even get why this option is even there; why would they surrender if they were the first to attack? In the end it doesn't matter since they never will)
- Ask if there is a way to avoid bloodshed, which will open diplomacy
- Surrender

But when I am the one attacking, the options are:
- Tell them we are at war and will fight, when will result in two options; leave or attack
- Say you want to discuss something, which will often end up convincing them to leave their liege
- Just leave
This makes no sense! The NPC will often say something along the lines of "we do not which to fight you" (even though they have been chasing me and run when I turn around, which makes no sense btw). Yet there is no possibility they will surrender or barter their way out.

NPCs should also be able to ask for barter or surrender pre-battle. It makes no sense that someone with an army of 50 (of which 40 recruits) won't beg for their live when facing an army of 170 full of trained troops. Why can't they surrender? Or offer a fief for peace/non aggression (but offering a fief doesn't seem possible anyway at the moment).
Pre-battle when attacking should be less black and white like pre-battle when being attacked

Seems that all npc Lords automaticly say: " I don't wish to fight you" when there are inferior in army strength. When i'm attacking a Lord that is sieging a castle or raiding a Village should say something more eloquent than that.
