Michael Allison faces up to 75 years in prison for recording police on camera without their consent. The crime is apparently eavesdropping. He faces 15 years per offense. State of Illinois.


 
You've got to be sh... me. When I read the title I thought he had a camera installed in a police precinct, what kind of crap is this? Land of the 75 years for the brave?

Michael Allison is an idiot but I don't think he is going to go to prison. He sued the police because they bothered him about his unregistered vehicles and then he followed them around with a camera, he needs to get a job or a hobby.
 
He is being charged with crimes that could add up to 75 years of prison time just so he can be tossed into the city jail for awhile, even if he were convicted of those crimes which is doubtful the judge doesn't need to sentence him to 75 years of prison. This is the police department retaliating against a goofy troublemaker, even the worst public defender will be able to lessen the charges.

If he was arrested by the F.B.I. without being told why and sent to the Guantanamo Bay prison camp no one would even know about it. That is the loss of freedom people should worry about, this news story is just sensationalism.

Ok as far as I know:

a) He filed a case because he felt the police did not follow proper procedure in confiscating his vehicles, his lawyer if he had one, would have advised him if he had a case or not. Apart from that, if you claim that he is an idiot for attempting to take the matter to the court then your basically saying he's an idiot for attempting to exercise his right when he believed due process was not followed. Whether or not it was is unknown to us and therefore its pointless to speculate. However if police retaliation is to be a norm for anything that people do, which may embaress or slightly annoy police officials then why the **** bother with freedom and rights in the first place.

b) He did not follow police around, the police arrived at his family's house when they confiscated his vehicle, in which case he wanted to document the process. He also did this when he went to the police station and did so again in turn when he was denied a court reporter.

c) Given the recent rise in videos detailing Police brutality, which in some cases has lead to deaths I am not surprised that video taping authorities is increasing at an alarming rate and it seems to me that the authorities aren't exactly rolling out the reforms or more stringent training and guidelines for their respective departments.

The problem still lies with the fact that filming the police shouldn't be considered a crime when they're at work, and according to the short piece of footage I've seen here (I'm usually not that interested in anecdotal pieces) it can be considered that in some of the states, and apparently it's spreading. Now I agree that pissing off the police intentionally is a bad idea and theres a good reason why the state has a monopoly on legitimate use of force, but the fact that it is abused in some cases does make this thing a little more disconcerting, at least with my limited knowledge on the whole U.S. law subject matter.

Oh come on, drunk kids in America don't even get the elevator ride anymore which means being dragged up and down a flight of stairs by their heels and killing a couple innocent bystanders during a police shootout used to be Okay, how much reform do you need? I think poor put upon Michael brought this on himself, it just doesn't make sense that there would be a campaign against him just for the hell of it. There is probably a lot we don't know about him and the police who just pulled his name out of a hat and started picking on him for no reason.

Edit: A reply before I posted from Damnation. Yes according to the short footage you have seen, there are thousands of people videorecording police all the time and they don't get arrested.

I actually live about a Kilometre from where the Last Samurai village was. So I live closer to Japan than middle earth.

I'm not saying the system is completely broken with regards to that, but as I said, if it's truly a thing which is enforced more and more then I think it's at least a little bit of a disconcerting development. I get that this specific issue is probably blown out of proportion and the 75 years are just to mess with him a bit :smile:

It's funny when people whine about us having "a totalitarian state of hur dur" and then you read headers like this.

In any case, I think we can all agree that the potential punishment does not fit the crime. I think we all doubt that he would get even more than 2-10 years per see but consider this. In Syria you get 4 years for insulting or criticizing the president/state.

So if we are to use the argument "You mess wit da police using legal channels and means then you deserve everything you get"...  what then?
