Enemy lord holds my kingdom's castle.

I have an odd bug, and just wonder if anyone can help me to solve it - the problem is that after I created a kingdom, and my marshal captured a castle, somehow appeared that castle became mine, but the lord of it left previous - means owner not changed, only faction of it. So, now I have my kingdom castle owned by enemy lord. The problem is that I can't resign it from him and give it to my lord (I have too much lords and too few fiefs atm - that makes a problem). And I can't accuse the lord of treason and strip him from all properties cause it's not my lord after all. So, if anyone have any ideas about how to return the ownership of this "rogue" castle - share them please, except starting new game of course (already did it cause of 1.004 patch). Thankies in advance.
