Does 1.41 contain the updated warband code?

just curious as to whether or not the updated warband code was in this patch or an upcoming patch.  stuff like marragie system, how lords recruit their armies, starting own kingdom etc.

No.  That effort is next-phase, and should start in earnest once the patching is completed - at least that is my understanding right now.

It should be a fairly involved effort to do properly due to the amount of encounter and script changes.
