Castle "Under Siege" with no Army nearby?

Is this a bug or simple a glitch... went to the Rhodok Lands, found two weakly defended castles, one had "Under Siege" under it's name, but no Swadian Army anywhere near. They were busy looting the village.

Also, I must be doing something wrong - whenever I come upon a siege (even with a massive Swadian Army around the Castle) I never get the option to join the Siege? But I'm Vassal of Swadia and can attack the enemy parties just fine, why am I missing the option to join a siege attack then....

AI parties can be in the area around a castle and it will still be under siege even if they're looting a village nearby

You can join a siege (battle) once the lords attack the castle and you will see a "Battle" over it

It seens to be less forgiving on player-instigated sieges

If the army rides away from a castle, to fight nearby enemies for instance, the castle will remain 'under siege' for another ingame day or so

Sometimes you have parties like this playing siege tag:

and they can steal it right under you if you don't stash your troops away and chase 'em down.
