They should be treated just as enemy soldier. If you want to recruit a spy, he can be a commoner, outlaw, or even part of the enemy faction.

I once played as an infiltrator. I joined one faction, on the orders of my leader in another faction, then started a war between that faction and a third one.
 
Hiring commoners is against the rules. I've nearly gotten banned for small mistakes in the mercenary-gets-hired process. It's hard to explain to a busy admin that you are on your way to the training station when you're surrounded by enemies.
 
It's one thing to hire commoners as soldiers (Skahrs company wasn't really peaceful). But as non-fighting personel (Engineers, doctors, spies, infiltrators) it's very legit. Who said differently?
 
I don't quite remember, but I do know that I was told somewhere that all persons who were hired had to join the faction.

On NA_PW4's site it says that.

1. One who serves or works merely for monetary gain; a hireling.
2. A professional soldier hired for service in a foreign army.

Mercenary =/= Spy/infiltrator

If you intend to fight, join the faction. This is in order to prevent confusion and randoming.

If you are a spy or infiltrator, no such limits apply, since you will not be fighting.

making 10 000 rules to control every player step to make sure he perform in perfect RP fashion will not prevent confusion
 
It is, especially in this case. say for example that you are fighting in a siege. A commoner just stands around beside you. Then all of a sudden he turns around and shoots you in the head and sais "Im a mercenary for them".

There is no way whatsoever to know whether a commoner is friendly or not, so it would just end with every commoner/outlaw in the area getting slaughtered, by both sides. And this would also lead to commoners and outlaws joining the fight because "they attacked us first Q_Q".

And in the end we would have a huge free for all deathmatch.
 
It is called transpassing and use to be describe by one rule. If owner of castle is not happy with visitor, visitor has to go away or he will be in trouble. Somebody come up with idea that this is free world and everybody can go where he wants. Faction lord can easily restrict access to his castle to his faction members only.

If he like to be open and take risk it is his policy and his problem. It should not be server admins problem and reason to create another rule.

Thats why, like assassins, you announce that you are working for X faction.
