    You can only release them right after battle. You will get an option to imprison them or to release them.

    i joined the southern empire and after i controlled 2/3 of empire lands, i gott a new quest that tasked me with conquering battania, vlandia and sturgia. My faction(southern empire) conquered 2/3 of sturgia at the moment but for some reason the southern empire never declares war on vlandia.
