It seems that I have to come back once more after all. Because if you want to screw people over in the game, it is sad, but after all it is only a game, but when it concerns real money of real people, it starts being serious.

First of all, PrideofNi, you have probably the most ridiculous arguments of all people in this community, no matter what you are arguing. Because what you said basically means that someone, who gave FSE money, is not promised anything and that he will be given a gift out of gratitude, but it has absolutely no connection to the money given prior to that. That means that if FSE decides not to give people anything, it is ok, they can do that, because there is no connection between the money and the things from FSE. Well, under such conditions I would think twice to give FSE any money now, because I am not guaranteed anything. I might not get copy of the game, if they don’t want to give it to me.

But I don’t think that is the case. They basically promised: “You will give us money, we will give you something in return”. It doesn’t matter whether you call it donation, pre-order, whatever. When I donate money, I don’t expect anything back. Here I was promised something for something. It is a simple relation between a company and a consumer. The whole point of it being a donation is ridiculous. Imagine that I would buy a laptop, the laptop would break down after a week, I would go to the shop and want my money back and they would say: “Well, you donated us the money and we just gave you this laptop out of gratitude, so you can’t get your money back”. How ridiculous is that?

Now, let’s get to the legal perspective. First of all, the whole issue about agreeing to the terms of use of the forum is irrelevant. You don’t need to agree to it, when you send the money to FSE. However, I agree that you can get banned from the forum based on that. But it has no connection to the money and the promise connected to them. You should also realize that you are changing the rules almost daily last two weeks, which is not really costumer friendly, because it means you can do whatever you want. If you make a rule tomorrow, that all people, whose name starts with H, will get banned, they can’t defend themselves, because according to you they agreed to the terms of use. You can see yourself, how ridiculous it is once again.

But the whole issue of being banned is irrelevant, because everyone, who asks for refund for whatever reason, must get it. And I will tell you why. You all are forgetting one very important thing. Even those, who argue in favor of the refund. The thing, which is important, are the terms people agreed to, when they sent FSE money. And there were no terms at all. Now there is a term that donation are non-refundable, but it wasn’t there before and I think that even this could be dismissed, because you don’t need to take any action, which says “I agree with this”, when you donate the money. You just click on Paypal, there is no agreement to those terms.

Anyway, there were no terms, when most of the people gave FSE money. FSE can claim that they meant the money given to them to be non-refundable, but customers can claim that they thought they can get refund at any point, when they ask for it. There is a conflict, which must be resolved. The laws of consumer protection in European Union deal with such a conflict very easily. If there is something unclear in the contract between a consumer and a company, the authorities always use the interpretation, which is more favorable for the consumer. That is a simple rule, which is always applied. In other words, everyone, who gave FSE money before the new disclaimer, is entitled to get his money back, if he asks for them. At any point.

Maybe FSE should have looked at kickstarter.com first, before they made their own project. Because if you look there, they have terms of use, which clearly state (among others) that “Kickstarter does not offer refunds. A Project Creator is not required to grant a Backer’s request for a refund unless the Project Creator is unable or unwilling to fulfill the reward“. Why would Kickstarter spend the time and most likely the money for lawyer to make those terms, if it is all so self-evident, as you claim? And even they stated “unable or unwilling to fulfill the reward”, which would make them liable in this particular case as well, because FSE is unable to fulfill the reward of access to the special subforum, when they ban the people. The reason is irrelevant. They are unable to fulfill the promise. But as I said, this is not important, because you had no terms of use anyway and thus you are fully liable.

I don't know if that is true, but I think that that is a stronger relationship than just mutally liking another admin.
Especially if you consider that most of the admins have never talked with Hancock apart from a handful of forum posts.
And it's not the other admins to blame, it's not their fault that Hancock never visited the official servers nor the official teamspeak and only rarely visited the admin forum.

I hoped that if I leave, I will not have to deal with Vince's cronyism and his cronies anymore. But it seems, you just cannot forget and leave it be once and for all. So if you wish to drag me in again, I will give you, what you want.

I have never denied that I reside in former 15e teamspeak. I have even my own channel there. Those are the people I know best and some of them are my friends. That has never been a secret. But you should answer those three questions, Hekko asked, because those are important questions.

Secondly, this activity of mine is very bad argument given the precedent, which was being created by Praetorian for one and half year. He has hardly ever played and almost never been on the official teamspeak. I dont play the game, because after some 2000 hours of playing it, it is incredibly boring for me. I also thought it is not bad, but actually good that I dont play on the server, because then I dont get directly involved in bans and I look more impartial. Even though I didnt play there, I had better knowledge about what was going on there than anyone else. However, because you criticise me for that, I looked at your activity. Since 1st December to 23rd January, you played on the server 5 hours. You are an admin, not a head admin. You dont deal with ban/unban requests. Your only job was to admin on the server, yet you hardly did it. I spent much more time on ban/unban requests during that time period, than you spent on the server. Also, I have banned more people than any other admin given the ban requests. It is logical, but it also means that my effort helped the server much more than your almost non-existent effort.

Thirdly, what should I talk about with the other admins? What did Praetorian talk about with admins? What do Cenzii or Vince talk about with admins? If they had problems, they could easily contact me (some of them did) and I helped them. If they did something wrong, I told them. I dont see anything more to talk about, if they dont belong to my friends. If they do, then I talk about different things than some admin stuff. Also, I didnt know, Mahud, that you know about every single conversation I have ever had with other admins.

Last point. You all should forget, leave it be and move on, because that is the best solution for FSE to just ignore us. Because if you want to continue, if you really want to provoke me, then we can start the fight, I dont have a problem with it. I was talking in general terms, when I left, but I can be very specific and I can also include all the necessary evidence. So you have basically two choices. First, forget it and let it die without an answer or continue arguing and then face the consequences I will impose on you. But before you decide to choose the second option, I would discuss it with Vince first, if I were you. Make your own choice. You should realize (if you havent yet) that this is not about Carolus not getting an admin. NOT AT ALL. That was very last piece of Vince's arbitrary decisions, which were the main problem.

You forgot the fourth week. So not tomorrow, but next Friday.

Since I saw the movie Gettysburg some maybe 15 years ago, I have been interested in the history of the American Civil War and I have always found the character and life of General Hancock astounding. He was a soldier his whole life, at the beginning of the war he became brigadier general, later promoted to major general, he earned the nickname "Hancock the Superb" in the Peninsula Campaign, he was one of the main figures in the Battle of Gettysburg, where he was seriously wounded. After the war he was the commander of the Military Division of the Atlantic and in 1880 Democratic candidate for the Presidency of the United States. However, he lost the election although very narrowly.

Later, General Francis A. Walker wrote about him: "Although I did not vote for General Hancock, I am strongly disposed to believe that one of the best things the nation has lost in recent years has been the example and the influence of that chivalric, stately, and splendid gentleman in the White House. Perhaps much which both parties now recognize as having been unfortunate and mischievous during the past thirteen years would have been avoided had General Hancock been elected."

Anyway, would you like to describe anything more what led to this outcome? Did you have any prior conversation or did just come there and said "I will hack this ts"?

He got slayed for it and later temp banned for his expressions. I dont see a reason to perm ban him, he was punished.

I dont see it as a community issue. It is a personal problem between you two. It starts with you, it ends with you. Simple as that.
