In the download page you say "You dont even need to have warband installed", so you don't need warband to play this warband mod? if so it would be illegal wouldn't it?

It is legal, yes. "You dont even need to have warband installed" means that all files needed to launch the mod are included in the package. Still, you have to OWN Warband in order to be able to play the mod, since the game will ask you for your serial key.
