HBRiding bugs?

I've noticed two possible bugs related to hbriding -- are they bugs?

1) I have followers (e.g., Bahestur) who have 12 agility but are not getting the option to upgrade to 4 riding upon level up
2) I can assign horses requiring a higher hbriding skill to myself and companions who don't have that level of skill
